Gerry Armstrong again. The hearing on Scientology's motions for summary
adjudication in my case is now set for October 6, 0900 Marin County
Superior Court, San Rafael, CA. Everyone is welcome!
This is the order Scientology has submitted to Judge Gary W. Thomas to sign.
"Defendant Gerald Armstrong, his agents, employees, and persons acting in
concert or conspiracy with him are restrained and enjoined from doing
directly or indirectly any of the following:
1. Voluntarily assisting any person (not a governmental organ or entity)
intending to make, intending to press, intending to arbitrate, or
intending to litigate a claim against any of the persons or entities
referred to in paragraph 1 of the "Mutual Release of All Claims and
Settlement Agreement" of December, 1986, regarding such claim or regarding
pressing, arbitrating, or litigating it;
2. Voluntarily assisting any person (not a governmental organ or entity)
defending a claim, intending to defend a claim, intending to defend an
arbitration, or intending to defend any claim being pressed, made,
arbitrated or litigated by any of the persons or entities referred to in
paragraph 1 of the "Mutual Release of All Claims and Settlement Agreement"
of December, 1986, regarding such claim or regarding defending,
arbitrating, or litigating against it;
3. Voluntarily assisting any person (not a governmental organ or entity)
arbitrating or litigating adversely to any person or entity referred to in
paragraph 1 of the "Mutual Release of All Claims and Settlement Agreement"
of December, 1986;
4. Facilitating in any manner the creation , publication, broadcast,
writing, filming audio recording, video recording, electronic recording or
reproduction of any kind of book, article, film, television program, radio
program, treatment, declaration, screenplay or other literary, artistic or
documentary work of any kind which discusses, refers to or mentions
Scientology, the Church, and/or any person or entity referred to in
paragraph 1 of the "Mutual Release of All Claims and Settlement Agreement"
of December, 1986;
5. Discussing with anyone, not a member of Armstrong's immediate family or
his attorney, Scientology, the Church, and/or any person or entity
referred to in paragraph 1 of the "Mutual Release of All Claims and
Settlement Agreement" of December, 1986;
6. Acquiring or creating in the future any repository, collection, or
database (electronic or otherwise) of writings, recordings, documents, or
books of any kind, which discuss or concern Scientology, the Church and/or
any person or entityreferred to in paragraph 1 of the "Mutual Release of
All Claims and Settlement Agreement" of December, 1986.
In addition, it is ORDERED that, within 20 days of the issuance of this
Order, Armstrong shall:
1. Remove all information concerning Scientology, the Church and/or any
person or entity referred to in paragraph 1 of the "Mutual Release of All
Claims and Settlement Agreement" of December, 1986 from any and all
databases, electronic or otherwise, within the possession, custody or
control of FACTNet;
2. Return to the Church any documents which he now has in his possession,
custody or control which discuss or concern Scientology, the Church
and/or any person or entity referred to in paragraph 1 of the "Mutual
Release of All Claims and Settlement Agreement" of December, 1986 , other
than documents which have been filed in this litigation.
It is further ORDERED that during the pendency of this litigation,
documents which have been filed in this litigation may be retained by
Armstrong's counsel. Those documents are to remain sealed, in the
possession of Mr. Greene or any successor counsel, and may not be
distributed to third parties. At the conclusion of the instant
litigation, it is ORDERED that all documents from this case in counsel's
possession which do not comprise counsel's work product will be delivered
to counsel for plaintiff. Counsel's work product may be retained by
Armstrong's counsel."
The "persons or entities referred to in paragraph 1 of the "Mutual Release
of All Claims and Settlement Agreement" include:
"officers, agents, representatives, employees, volunteers, directors,
successors, assigns and legal counsel of CSI as well as the Church of
Scientology of California, its officers, agents, representatives,
employees, volunteers, directors, successors, assigns and legal counsel;
Religious Technology Center, its officers, agents, representatives,
employees, volunteers, directors, successors, assigns and legal counsel;
all Scientology and Scientology affiliated organizations and entities and
their officers, agents, representatives, employees, volunteers, directors,
successors, assigns and legal counsel; Author Serrvices, Inc., officers,
agents, representatives, employees, volunteers, directors, successors,
assigns and legal counsel; L. Ron Hubbard, his heirs, beneficiaries,
Estate and its executor; Author's Family Trust, its beneficiaries and its
trustee; and Mary Sue Hubbard."
The Scientology organization seeks not only to silence my voice of
opposition to its antisocial doctrines and practices, it seeks through
this case to get its hands on FACTNet's Scientology archive. These are
the same materials the organization's lawyers and personnel seized in
their raid on FACTNet, and which on September 15 were ordered returned to
FACTNet by US DistrictCourt Judge Kane in Denver. This must not be
allowed to happen. FACTNet is again at risk. Spread the word.
What Scientology's leaders are doing in my case, with FACTNet, with Dennis
Erlich, Arnie Lerma, Lawrence Wollersheim, Bob Penny, and with any other
of their perceived critics, whom they attack and seek to silence, is in
violation of the organization's own "creed," which states in significant
part:
"We of the Church believe:
...That all men have inalienable rights to their own religious practices
and their performance;
...That all men have inalienable rights to conceive, choose, assist or
support their own organizations, churches and governments;
...That all men have inalienable rights to think freely, talk freely, to
write freely their opinions and to counter or utter or write upon the
opinions of others;
...And that no agency less than God has the power to suspend or set aside
these rights, overtly or covertly."
CSI, the Scientology entity the organization has used to sue me, states in
its bylaws at article 4:
"The Church subscribes, and its object is and purposes are that all
Mankind may subscribe to and practice [its] Creed." CSI then repeats the
"creed" in which the above quotes appear.
Scientology states in its book "What is Scientology?" that it "adopted
[the "creed"] as official because it succinctly states what Scientologists
believe."
But it is not what Scientologists believe, or at least the Scientologists
who decide what Scientologists believe and who can be one. Scientology's
leaders those directing its litigations and responsible for its attacks
on targeted "enemies" have no respect for this "creed," and violate it
blatantly.
Scientology submitted this creed in support of its applications for tax
exempt status for its various entities. Presumably the IRS and courts
accepted Scientology's assertion that this "creed" is indeed the
organization's "creed," and that Scientologists have adopted and live by
it.
This fraud by Scientology in its applications for its tax exempt status
should be exposed. Scientology's violations of its targeted "enemies'"
civil rights speech, religion, assembly, due process, equal protection
cannot be purposes for which its taxexempt monies can legally be used.
This too should be opposed and exposed.
Scientology's leaders and lawyers, through the secular courts, through
intimidation, dirty tricks and all other facets of their "fair game"
doctrine, seek the suspension, setting aside and suppression of the rights
their "creed" states that they support.
They are no respecters of other people's religious practices; of other
people choosing and assisting other organizations; of other people
thinking, talking and writing freely; and of other people talking and
writing freely on their opinions.
These leaders and lawyers, arrogate to themselves the power they state in
their "creed" belongs to God. They can do this, they believe with
impunity, because they do not believe, nor are they permitted to believe,
in God. Hubbard asserted in his writings, which Scientology claims are
its "most sacred scriptures," that God is an "implant," designed to
enslave man.
If a Scientologist is one who believes and lives according to
Scientology's "creed;" if its leaders' "enemies" live according to the
"creed;" and if these leaders overtly and covertly and day in and day out
violate this "creed," then who are the Scientologists?
October 6 is therefore a day for all Scientologists to support their
creed. It is a day for all Scientologists to show up and shut down the
creed violators. It is a day for the freedoms the creed sanctifies
